Terms of Use


This represents a legal agreement between Shadowmeld Photography and Visitors to its Website. The terms are defined below for the purpose of this agreement, and together with our Privacy Policy, License Agreement, and guidelines throughout the Website define Shadowmeld Photography's Legal Terms, and by visiting the Website, these Legal Terms are agreed to. The most recent copy of this agreement is posted to the website immediately following changes or amendments. It is the visitor's responsibility to review the Terms of Use when visiting the Website. Shadowmeld Photography's Terms of Use are a binding agreement, and if they are not accepted, we request immediately discontinuing the use of this Website.

1.1 The terms "us" or "we" or "our" refers to Shadowmeld Photography, the owner of the Website.
1.2 The domain shadowmeld.com and its Intellectual Property is known collectively as the "Website"
1.3 "Legal Terms" are defined as the collective of our Terms of Use, Privacy Policy, License Agreement, and any guidelines available on the Website.
1.4 A "Visitor" accesses Content on the Website
1.5 Intellectual Property in the digital form of written words, Asset(s), images, data, and information offered through the Website or any of its services is collectively known as our "Content"
1.6 An "Asset" is a purchasable digital file obtained through the Website.

COMPLIANCE
2.1  As a Visitor, you agree to comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding use of the Website in respect to both your location and the United States of America.
2.2  Shadowmeld Photography reserves the right to monitor downloads and user activity to ensure compliance with the terms of the Agreement and; (i) suspend access to a Visitor's user account and; (ii) to investigate and report complaints or violations of our Legal Terms and; (iii) to seek legal remedy if the Terms of Use are breached.
2.3  We may take any action we deem appropriate to provide legal resolution by requesting parties, including reporting suspected unlawful activity to law enforcement officials, regulators, or other authorized parties in both the Visitor's location and the United States of America.
2.4  We will disclose any information necessary and appropriate for officials to uphold regulations to the extent of the law. Information we may disclose to serve the law's request includes Website usage history, computer IP addresses, account details, and traffic information as permitted and governed by our Privacy Policy.
2.5  Copying, redistribution, use of or publication of any portion of our Website is strictly prohibited without our expressed written consent.
2.6 Images uploaded and posted to this website are licensed by (CC BY-SA 4.0) Attribution-ShareAlike 4.0  International - Please contact us if you are unsure about what images are licensed under this attribution.

INTELLECTUAL PROPERTY
3.1 Use of our Website does not constitute any right or license for to use service marks, trademarks, Content, or wording without prior written permission of the corresponding service Content owner.
3.2 The Website in its entirety; including (i) Content, (ii) sub-domains attached to the shadowmeld.com domain; (iii) any downloadable Asset and; (iv) any associated documents copyrighted by Shadowmeld Photography as defined in clause 1 of the Terms of Use Agreement will be known as Shadowmeld Photography's Intellectual Property.
3.3 Any "Asset" obtained by purchase and download from Shadowmeld Photography is subject of the License Agreement at the time of download.

NOTICE
4.1 Legal terms described in the Terms of Use Agreement are subject to change without written notice.
4.2 The most recent copy of the Agreement is posted on the Website immediately following changes or amendments.
4.3 It is the Visitor's responsibility to review the Terms of Use when visiting the Website.

GOVERNING LAW
5.1 This Agreement will be construed by and governed in accordance with the laws of the United States of America without regard to conflict of law principles.
5.2 The Visitor agrees to submit to the personal jurisdiction and venue of such courts.

WAIVER
6.1   Any cause of action by you with respect to our Website, must be instituted within one month after the cause of action arose or be forever waived and barred.
6.2 Should any part of our Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.
6.2  To the extent that Content in our Website conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence.
6.3  Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision.
6.4  The rights of Shadowmeld Photography under our Legal Terms shall survive the termination of our Legal Terms.

Trail Boardwalks

A fun element to hiking new trails beyond seeing nature up close is encountering stretches of wooden boardwalks leading across marshy land and over water or small valleys. Perhaps part of the interest in seeing trail boardwalks is the irony, that trees in the area were cleared and replaced with repetitive patterned pathways made of wood. While boardwalks might represent the piece of forest replaced by forest parts for human travel, they nevertheless lead explorers further into the trek by enticing hikers with unknowns ahead.
